Affiliate Program Terms of Service
Effective: November 5, 2025
These Terms of Service ("Terms") govern your participation in the Berges Institute Affiliate Program ("Program"). By participating in the Program, you agree to comply with and be bound by these Terms.
1. Enrollment
- To join the Program, you must create an account on our website.
- You must be at least 18 years old to participate.
- Berges Institute SLU ("Berges Institute," "we," "us," or "our") reserves the right to remove any affiliate at any time, for any reason, at our sole discretion.
2. Affiliate Links and Tracking
- Each affiliate receives a unique referral link.
- When a user clicks your link and completes a qualifying purchase within 30 days, the sale is attributed to you.
- Attribution is tracked for 30 days from the initial click. If a customer clears their browser data or uses a different device, we cannot guarantee attribution.
- You may not modify your tracking link or engage in any behavior that manipulates tracking, including self-referrals, forced clicks, or fraudulent activity.
3. Commission and Payment
- Commission rates are displayed on the affiliate program page. Rates may vary by region.
- A qualifying sale means a completed, fully paid purchase of the "Deal for absolute beginners" that is not canceled or refunded.
- Commissions are calculated monthly and paid automatically at the end of each month via Wise to your account email address.
- You are responsible for ensuring you have a Wise account associated with your email address and for providing accurate payment information.
- You are responsible for any fees charged by your payment provider and for declaring and paying any applicable taxes in your jurisdiction.
4. Prohibited Conduct
Affiliates must not:
- Misrepresent Berges Institute, our courses, or your relationship with us
- Offer unauthorized discounts, coupons, or promotions
- Send spam emails or use deceptive marketing practices
- Use websites, videos, or social media content containing illegal, hateful, or adult material
- Purchase courses through your own affiliate link (self-referrals)
- Use paid advertising that targets our brand terms without prior written approval
Violation of these rules may result in termination and forfeiture of unpaid commissions.
5. Content and Disclosure
- You must accurately describe Berges Institute and its programs. Do not make unsubstantiated claims.
- All promotional content must include a clear affiliate disclosure (e.g., "I may earn a commission if you enroll through this link"), in compliance with FTC guidelines and applicable regulations.
6. Term and Termination
- Either party may terminate this agreement at any time by email notice.
- We reserve the right to suspend or terminate your participation immediately if we believe you have violated these Terms or engaged in fraudulent or abusive behavior.
- Upon termination, unpaid commissions for verified sales will be paid in the next scheduled payout. Pending or unverified commissions may be forfeited.
7. Program Changes
We may modify the Program, including commission rates, qualifying products, or payment methods, at any time. Changes will be posted on this page. Continued participation after changes constitutes acceptance.
8. Independent Contractor Status
You are an independent contractor, not an employee or representative of Berges Institute. You have no authority to make commitments on our behalf.
9. Limitation of Liability
We are not liable for indirect, incidental, or consequential damages arising from your participation in the Program. Our total liability shall not exceed the total commissions paid to you in the 6 months preceding any claim.
10. Governing Law
These Terms are governed by the laws of Spain. Any disputes shall be handled by the competent courts of Spain.
